Who Is Responsible for Processing Your Personal Data?

HERASA NEUTRAL CARGO, S.L. is the CONTROLLER responsible for processing the USER’s personal data and hereby informs the USER that such data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Spanish Organic Law 3/2018, of December 5 (LOPDGDD).

Why Do We Process Your Personal Data?

To maintain a business relationship with the user. The processing operations envisaged are:

• Sending promotional communications by email, fax, SMS, MMS, social media, or any other electronic or physical means, whether existing now or in the future, that make it possible to send commercial communications. These communications will be sent by the CONTROLLER and will relate to its products and services, or those of its partners or suppliers with which it has reached a promotional agreement. • Processing orders and requests, responding to inquiries, and handling any other type of request made by the USER through any of the contact channels available on the CONTROLLER’s website.
• Sending the online newsletter with news, offers, and promotions related to our business.
• Receiving, processing, managing, and storing reports.

On What Grounds Can We Process Your Personal Data?

Because the processing is legitimized under Article 6 of the GDPR, as follows:

• With the user’s consent: sending promotional communications and the newsletter.
• On the grounds of the CONTROLLER’s legitimate interest: conducting market research, statistical analysis, etc., and processing orders, requests, reports, etc., at the USER’s request.
• Unambiguous consent given through a clear affirmative action by the data subject: receiving CVs.

How Long Will We Keep Your Personal Data?

Personal data will be kept for no longer than necessary to fulfill the purpose of the processing or as required by applicable legal provisions. Once no longer necessary, the data will be deleted using appropriate security measures to ensure its anonymization or complete destruction.

Who Do We Share Your Personal Data With?

Data may be shared with group companies for the same purpose or where legally required. No disclosure of personal data to third parties is envisaged, except where necessary for carrying out the purposes of the processing, in which case it may be shared with our communications service providers, with whom the CONTROLLER has entered into confidentiality and data processing agreements as required under current privacy regulations.

The USER is entitled to the following rights:

• The right to access, rectify, and port their data, to request its erasure, and to restrict or object to its processing.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By checking the corresponding boxes and entering data in the fields marked with an asterisk (*) on the contact form, or submitted through download forms, USERS expressly, freely, and unambiguously agree that this data is necessary for the CONTROLLER to handle their request, while providing data in the remaining fields is optional. The USER guarantees that the personal data provided to the CONTROLLER is accurate and agrees to notify the CONTROLLER of any changes to it.

The CONTROLLER informs users that all data requested through the website is mandatory, as it is necessary to provide the USER with an optimal service. If all data is not provided, the CONTROLLER cannot guarantee that the information and services offered will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with current data protection regulations, the CONTROLLER complies with all applicable GDPR and LOPDGDD provisions regarding the processing of personal data under its responsibility, and specifically with the principles set out in Article 5 of the GDPR, under which such data is processed lawfully, fairly, and transparently in relation to the data subject, and is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed. The CONTROLLER guarantees that it has implemented appropriate technical and organizational policies to apply the security measures required under the GDPR and the LOPDGDD, in order to protect the rights and freedoms of USERS, and has provided them with the appropriate information to enable them to exercise those rights.
